Consulting Terms of Service

These Consulting Terms apply to paid consulting services provided by Growing Gifted, including Parent Consultations, Teacher Consultations, School Leader Consultations and Extended Engagements (together, the “Consulting Services”). They apply alongside our general Terms of Service, which govern your use of the Growing Gifted website and other services.
Who provides the service
Consulting Services are provided by Danielle Welsh, a registered Queensland teacher with specialist qualifications in gifted education and experience in education and curriculum leadership.
What the service covers
Consulting Services provide evidence-informed educational guidance relating to gifted education, including learning needs, educational options, curriculum, differentiation, acceleration, advocacy and related educational decision-making.
Consultations are based on the information and circumstances you share with us and are intended to help you better understand your situation and consider appropriate options.
What the service does not cover
Growing Gifted provides educational guidance. Consulting Services are not psychological assessment, diagnosis, counselling, psychotherapy, medical advice, legal advice or treatment.
Danielle Welsh is not an AHPRA-registered psychologist and does not provide psychological or clinical services through Growing Gifted.
Where a matter requires specialist clinical, medical, psychological, legal or other professional advice, we may recommend that you seek advice from an appropriately qualified professional.
Consulting recommendations do not replace formal assessment or professional advice where that expertise is required.
Recommendations and outcomes
Recommendations are based on the information available at the time of the consultation and may change as further information becomes available.
We cannot guarantee a particular outcome for your child, classroom or school. The implementation of recommendations, and decisions made following a consultation, remain the responsibility of the relevant parent, educator, school or organisation.
Where appropriate, we may recommend further assessment, professional advice, or discussion with your child’s school or another qualified professional before a decision is made.
Payment
Fixed-price consultations are paid in full at the time of booking.
Extended Engagements are quoted and invoiced individually, based on the scope of work agreed in advance.
Any additional work outside the agreed scope of an Extended Engagement will be discussed and agreed before additional fees are incurred.
Cancellations and rescheduling
We ask for at least 24 hours’ notice to cancel or reschedule a consultation.
Where at least 24 hours’ notice is provided, you may reschedule your consultation or request a refund.
Sessions cancelled with less than 24 hours’ notice, or missed without notice, are generally non-refundable. We will use reasonable discretion in genuine emergencies or exceptional circumstances.
If Growing Gifted needs to cancel or reschedule a consultation, you will be offered the option to reschedule or receive a full refund.
If you arrive late to a consultation, the session will generally finish at the originally scheduled time. We may use discretion where circumstances outside your control have caused a significant delay.
Confidentiality and privacy
We respect the privacy of information shared during Consulting Services and will handle personal information in accordance with applicable Australian privacy laws and the Growing Gifted Privacy Policy.
Information shared during a consultation will not ordinarily be disclosed to another person or organisation without your consent, except where disclosure is required or authorised by law, or where disclosure is necessary to address a serious and immediate risk to a person’s safety.
Where a consultation involves information about a child, parents, educators and school leaders remain responsible for ensuring that they have the appropriate authority or consent to provide information about that child to Growing Gifted.
Recordings and notes
Consultations are not recorded unless this has been agreed in advance by all relevant participants.
We may make brief notes during or after a consultation for the purpose of providing the service, maintaining appropriate records and following up on agreed actions.
We will not use identifiable information from a consultation for marketing, case studies or other public purposes without your separate consent.
School and organisational consultations
Where a school or organisation books a Consulting Service, the school or organisation is the client unless otherwise agreed in writing.
Growing Gifted provides advice and recommendations to the relevant adult or organisation. Unless expressly agreed otherwise, Growing Gifted does not provide services directly to students or assume responsibility for implementing recommendations within a school, classroom or family.
Where a consultation concerns an individual student, the person or organisation providing information about that student is responsible for ensuring they have the appropriate authority to share that information.
No guaranteed outcome
Consulting Services provide professional guidance based on the information you share and the available evidence. Because educational outcomes depend on many factors outside our control, we cannot guarantee a particular outcome for your child, classroom or school.
Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under Australian law.
To the maximum extent permitted by law, Growing Gifted and Danielle Welsh are not responsible for decisions made by a parent, educator, school or organisation following a consultation, or for outcomes resulting from the implementation of recommendations where those outcomes are outside our reasonable control.
Governing law
These terms are governed by the laws of Queensland, Australia.
